Q.

I-140 EB3 and/or I-130

Hi,

I have been on H1-B visa since Oct 2005. My current H1-B will expire on Sep 30, 2011.

My husband has been a permanent resident since April 6th, 2005. He hasn't filed a green card application for me yet. We are waiting for him to become a citizen at the end of 2010 or early 2011. Then he can sponsor my green card (I-130), but we are worried that my H1-B might expire before the I-130 is approved.

My employer could also sponsor me a green card (EB-3 category), but I have to sign a contract to work there 2 years AFTER I get my green card.

Filing both I-130 and I-140 seems to be the safest route to go, but I don't really know if I want to be bound by a contract that might end up lasting 5-6 years. (EB3 Visa number now is MAY05).

Please advise.
