Currently I have been in the US first as a student for 1.5 years and now as an H1b for almost 4 years. My employer has not managed to get my labor certification in the first attempt and they want to try again.
On the other hand I have a family visa number becoming available through my US citizen brother in possibly a little less than 2 years. He currently lives abroad but has repeatidly been thinking about moving to the US. I was wondering if there is a recommended minimum time frame he should have spent in the US for successful filing.
