Q.

H1 TO F1 Change of status

My H1 status ends 09/30/09; employer is OK to apply extension for 3 more years.
I-94 ends 10/10/09
Start date on I-20 - 09/24/09
Wife is on H-4 and will give birth on 10/30/09. Travel to India for F-1 visa may be medically risky.

1. If I apply for Change of status (COS) in US, should I file a separate I-539 for her F-2? If so, how much is the fee for her application?

2. I need COS till June 2011 but my passport expires on 02/25/11. Can USCIS deny my COS because of the expiry date on my passport?

3. If I'm denied the COS after 09/30/09, can I apply for H1B extension even if my H1B petition has expired by then?

4. If I travel to India to get F-1 visa, can I use current H1B after school (2011) without going into the new quota?
