Q.

H1-B CAP and H1B CAP-exempt

My current employer applied for my H1-B CAP Visa and it was approved and will be activated at Oct. 1. Now I got an academic offer (tenure track) and accepted this job.

1)I am working now under OPT but it will be expired on August 05. I need to start my new job on August 22. Can I transfer my H1-B Cap Visa to university while my Visa will be activated on Oct. 1 and also it is H1-B Cap? (As you know I can work for my current employer in gap between OPT expiration and Oct. 1, does this fact apply for working for another employer)?

2)In case the university has to apply for another H1-B do I need to cancel my H1- B Cap and when dose the university have to apply?

Best Regards,
Ana
