Q.

I-539 denial & i 290-B

Hello.
1. My i-94 expired on December 15, 2008
2. In the beginning of December 2008 I filed i-539 petition to exchange my status from B-2 to F-1
3. In June 2009 I got denial on my petition, because my sponsor's financial docs was not sufficient (actually they didn't see them)
4. I immediately filed I-290B to reconsider my case.
Question: since my I-94 expired, is this i-290 petition allows me to stay in US while it's pending? Or I'm already should be aware of deportation since my 180 days period is gone? And I'll be also very appreciate if it's possible for you to give me a link to a law, which is clarify this question.
P.S. I asked at least 10 lawyers already & nobody can tell me firmly yes or no...
