Q.

H1B to F1 - I539 Query

Hi, Heres my case
1. H1 (and I94) from Comp A expired on Jan 20th 2009
2. H1 extension/ Transfer by Comp B was in process at the time
3. Comp B gets a query on the Trfr petition in March 09
4. Comp B sends me a termination email on March 20th
5. I do get a paycheck on April 15th as part of my severance pay.
6. Comp B officially withdraws my H1 Transfer petition on April 23rd
7. In the meantime I apply for a COS,(H1 to F1), receipt date was April 2nd.
8. Its over 2m now, had received a query on I539 (was answered on May 28th) asking for latest H1 approval copy and latest paystubs, which was submitted. still waiting on the decision.
Q:Would I be required to go to Home country for F1 stamping incase my COS is approved-since my I94 and H1 was expired when i applied for I539?
