Q.

Adjustment of Status (485-pending) to F-1 status

To re-cap, I have a pending AOS status (PD: May 2006) and want to go back Full-time to School. If I quit my current job my employer is going to revoke my H1B and I-140 applications.

Case1: Assuming that I quit and my H1B and I-140 applications are revoked. IF CIS issues a RFE 3-4 months into my School. Is it sufficient that I have a future Job offer (similar or same) to continue my Schooling? This is assuming that my AOS application is 'not current' and is under pending status.

Case 2: If my employer lets me go on a Long term leave (which means my I-140 will not be revoked) and RFE is issued will I have to go back to employment?

Do I have to be employed even if the AOS status becomes current? OR only once the AOS application is approved?
