Q.

F2 to H4 COS

I am in USA, have F1 visa till 22 Dec 2012.
Wife is in back home, has F2 visa till 22 Dec 2012.
I am travelling home in May 2012 for 2 weeks.

My employer is filling my H1b+COS(f1-h1) in June 2012 (after I come back). But Wife wants to travel in August 2012. She has exams over there in July 2012.

when my H1b petition is pending or approved.

1. Can my wife enter in USA on F2 visa in August.

2. Will it be any issue on her entry in USA on F2, if my employer files her COS (F2-H4) with my H1b .

3. Should I tell my employer not to file her COS with my H1b petition because she wants to travel in August.


4. Please give me ur suggestions. I want to be on save side. that's why I am travelling in May and after coming back company applying for my H1b.
