Q.

F1

Hi,

My wife plans to go to school this fall and we're doing her COS from H4 to F1, so that she can work on campus and accept assistant ship.
I've an approved I-140 and will be extending my H-1 status by another 3 years as my 6th year of H-1B expires Jan 2012.

- We plan to visit India this December 2011 and get an F1 stamp for my wife and H-1 for myself.
Could there be any issue when I go for visa stamping or at the port of entry considering that I've an approved I-140,

- How to answer if the visa officer asks whether you've initiated Employment based GC or not.

- We plan to have a baby in fall 2012 and my wife plans to take a break for that semester and join school again in Spring 2013. How can she maintain her status in that scenario.
