Q.

(Employment Issue) STEM OPT to H1-B from Non-E-verify Employer

Hi,

I am an electrical engineer (non-US citizen) in NY, currently on OPT STEM extension till Jul 2011 working for an E-verify enrolled company. I am being offered a job by another company which is not enrolled in E-verify but is ready to file my H1-B as soon as I join. I can't work for this new company right away as they are not enrolled in E-verify. Is it possible to work for the company before my H1-B is approved or do I have to await the decision? Do I get anything like a Cap-Gap benefit or something else that will enable me to work for the new company as soon as they apply for my H1-B or not? If I have to await the H1-B decision is there any other way that will let me work for the new company immediately? What approach would you advise in the above cases?
