Q.

H1 to F1

I am pursuing my MS from a US university on H4 visa. My husband is on H1 visa and his I-140 is approved. At this point, I am not part of the GC process but would be added to the GC application at I 485 stage. I would like to convert to F1 visa to avail the OPT option after I graduate.

1. Is there a risk of F1 denial because my husband's I-140 is approved which shows intent to migrate to the US? Would travelling to India and applying for F1 at the local US consulate reduce the risk, if any?

2. Any issues with the GC process after I have converted to F1?
