F1 / OPT
- Worked on H1 from March 2008 - October 2008
- Traveled to India in October 2008 and returned back to the US in May 2009 on H4 after getting married, Also, resigned from the original employer.
- Enrolled for MS program in January 2010 with expected date of degree completion May 2011
1. How long do I have to be on F1 before I can avail OPT; If I convert to F1 from H4 in August 2010, will I be able to get OPT in April 2011 upon graduation?
2. My spouse has approved labor and I-140. The priority date is not current yet. In this case would you advise against converting MY visa to F1? I am planning to travel to India in Dec 2010.
