Q.

F-1 to H-1

Hi,

I need some clarification on reviving / reinstate old unused H-1 visa & application process.

I did my OPT after graduation with a company. They applied and received my H-1 visa to start from Oct 1, 2009. Due to the economic downturn I was laid off on Aug 31, 2009 and notification sent to USCIS. I went back to school joined a new graduate program in Sept 24, 2010 and a new I-20 was issued under my existing F-1 visa and SEVIS status maintained.

I have received some job offers now in April and would like to apply for an H-1 visa.

- Will it be possible to have my old H-1 visa reinstated under a fresh application filed by my new employer?
- Can it start now or wait till Oct 2010?
- What application needds to be filed?
- what is the best route to apply?
