I am a college grad(02) was on f1 & OPT.my I94 is stamped D/S.opt ended 2003
Married my GC bf 05 we applied I130.I cant do AOS but I am afraid to go home for consular processing I130 approved may 09..NVC sent fee bill Dec for processing.my lawyer seems unsure as to whether the 3/10 ban applies to me.when we first applied in 05 she said it wouldnt that as DS I am not out of status until I leave the country..so I have not been home as my b2 visa was up from 04 so 02/03 was my last trip home.Will I be stopped on return at port of entry if I do CP.My husband applied for citizenship 05 and was denied for not registering for selctive services (he was not legal when he was eligible to register) we did not use a lawyer she told us this was simple(citizenship app) no lawyer needed. what can I do?
