Q.

Reinstatement of F1

I am out of status & planning to apply for Reinstatement of F1 visa or leave the country(No voluntary violation,my h1(with COS)was revoked(before OCT 1)lost OPT ext &so OOS since Oct1'09.On Sep28'09 my school DSO opened a SEVIS Datafix ticket,it got denied on Dec7'09)
1)Can i stay in US and apply for a new H1,as 2009 quota is open or should i leave & apply from my home country?
2)If I apply for F1 reinstatement and apply for H1 in April 2010 & If H1 is approved,can i discontinue my studies & take up the job,from Oct1,2010?Will this discontinuation impact my "HISTORY" in US or Green Card processing
3)Since,I am OOS since OCT(3 months)is it better i apply for F1 reinstatement to explain 3 months stay or leaving country now after 3 months,will I hav problems in future immigration processes
