Q.

H1B to F1 Visa

Hello,

I currently have H1B visa, I got an admit to PhD program for Fall 2010. I have an approved PERM petition, not yet applied for I-140.

1. Can I apply for F1 visa without any issues because of my approved PERM petition? Is PERM petition regarded as 'intend to immigrate'?

2. What happens if my I-539 is approved, and the school start date is more than 30 days away?
