Q.

possible application of opt with rejected I485

I am currently on F1 since may 2005 and I will graduate may 2010. My wife is on F2. In 2007 she got a job offer and her employer sponsored her for employment based green card. We applied concurrently for I140 (for her) and I485 both both of us. She got her EAD and worked for about a year, while I did not apply for it and continued working at university on F1 (as a grad research assistant). Early this year things went wrong and first I140 and then I485s were denied. She then stopped working and I believe her EAD become obsolete.
1) I want to apply for pre completion OPT this month. Is there any chance that my OPT (or current F1) will be denied based on our history?
2) Can a university apply for me for H1b (no quota) without going though OPT?Is this a safer option than #1?
Thanks
