I came to US on F1 visa in 2006 and my F1 visa expired on June 2008. I am presently on OPT 17 months extension, which expires on June 2010. I filed H1 thru company A this April 2009, and it got approved (effective Oct 1, 2009). I havent been working since july 2009.
I am planning to get married legally in Michigan this month.
My questions:
1. Company A has not run my payroll since oct 1, 2009. After I get married, I will be filing H4 thru my husband's company this month. Should I have minimum of 2 paystubs in order for me to get the change of status to H4 or am I considered to be on F1 OPT status since my payroll was never run thru company A?
2. Can I file for change of status to H4 without my paystubs?
On what status am I now, since my payroll has never been run thru company A?
