Q.

COS from H1-F1 approved after sem start. Query about Legal stay

My 1st three years of H1 (and I-94) expired on 09/30/09. After getting I-20 for Fall2009 (courses start on 09/02/09), filed change of status to F1 with USCIS on 08/18/09. I got a mail on 10/14/09 stating that USCIS sent the approval notice on 10/14/09. Now i believe that start date on the I-94 as 10/14/09.

1. School officials suggested me before the approval of case itself to differ to spring 2010 as almost half of the fall '09 semester is over. If i differ it to spring 2010 now, will i be considered maintaining legal status from 10/14/09 to start of spring 2010 semester? OR do i have to register for courses for fall 2009 to maintain my legal status?
2. If i differ it to spring '10, will my wife in india be eligible to go for F2 stamping in india and enter US anytime before spring 2010
