H1b to EAD transfer

Hi,
I am working on H1b as a full time employee for a software company that filed my Labor I 140 and 485, now I am getting laid off in a month. I have a valid EAD till Nov 2010 but I hadn't filled the I 9 form [ i.e I am on working on EAD].

What would be my status after I loose my job? Should I start working on EAD before I loose my current job. will I become out of status If I don't change to EAD now and don't get another job for some 'x' number of days after my current job? what would be x?

Also is it true that if I work on EAD for my next company, my job profile should be 90-95% similar to my current job profile otherwise there might be problems with Green card or its fine as long as the next company is also software company?
