Q.

Wife needs to quit job, does she need to convert to H4

I and my wife have a pending I-485 (I-140 approved already) with my wife being the derivative. We joined our companies on H1B. Last year we used AP to leave and return to US. After returning to US we resumed our jobs with our employers.

Here are my questions.

1. Given the fact that we used AP, are we in AOS or H1B status (we never used EAD)?.

2. If my wife (derivative) quits her job, does she need to change to H4 status.

3. Do we need to inform USCIS about her quitting the job. Does she automatically fall into AOS status.?
