Q.

LCA and H1B advise

My employer filed my EB2 labor in Dec 2007 and it got rejected last week... At the same time, he also filed EB3 in Oct 2008 and DOL had asked for RFE 2 months back, which was submitted, no news of it yet. Perm was filed from Chicago and i work in New York.

My 7th year H1 extension has been filed last month (current H1 expirin aug 31 2009 and extenion was filed july 14 2009) and its been a month now. What are the chances that things will flow smoothly and what are my other options?


Can i switch employers and apply a new Labor now? is it safe or stick to the same employer?
