My PERM was approved in Aug'07, and my I-140 (EB-2) got denied in Nov'08. An Appeal/MTR was raised in Dec'08. Now, my company's lawyers have agreed to file a new I-140 in EB-3 (since I have a 3-year degree) and cancel the Appeal for EB2. I want to seek advice if the new petition is according to the already filed PERM.
