Using approved PERM to file a new EB3 after a rejected EB2

My PERM was approved in Aug'07, and my I-140 (EB-2) got denied in Nov'08. An Appeal/MTR was raised in Dec'08. Now, my company's lawyers have agreed to file a new I-140 in EB-3 (since I have a 3-year degree) and cancel the Appeal for EB2. I want to seek advice if the new petition is according to the already filed PERM. Here is section H from the ETA 9089 (PERM): 3 - Sr. Analayst Business Systems, 4 - Education - Bachelors, 4B - Management Information Systems, 6 - Yes,6 A - 60, 7 - Yes,7A - Computer Science, Engineering or related field (FYI - I have a Bachelor Of Arts from India), 8 - No, 10 - Yes, 10A - 60, 10B - Related Position, 12 - Yes, 14 - EMPLOYER WILL ACCEPT ANY SUITABEL COMBINATION OF EDUCATION, TRAINING OR EXPERIENCE, 15 - No
(FYI-I have a Bachelor Of Arts from India +8yr.exp.)
