Q.

Regarding NIW

Hope you are doing fine .this is inregards to my question on 3/8/09.am briefing it again.
1)Status:
J1 residency 2003-2006 Internal medicine
J1 waiver : employer A started 9/06
Job change : & H1 transfer sec to extenuating conditions 8/16/07 (USCIS approved case in 1 week).
New H1 employer B : valid till 7/2010 in HPSA area

NIW : I-140 filed 2/22/07 with employer A
I485 3/15/07
I140 approved 8/08(employer petetioner)
approved EAD & AP (not used)

Your opinion was that i have portibility under AC21.
1)when i changed job it was <6 months after filing 485 & 140 though 140 got approved 1 yr later (probably not revoked by peteioner)

2)does portability law applies to NIW cases

3)I read a policy memorendum dated 1/23/07&8 CFR 204.12(f) which is confusing me.
