Q.

EB2 - Indian 2 yr Masters + 3 yr Bachelors+ 5plus yr experience

I have a 2 yr MBA and a 3 yr Bachelor’s degree in Commerce from Osmania University, India + 6yrs & 9mnths of prior work experience. Earlier, my company had asked for 'Masters' in its ETA-750 and my I-140 filed in EB2 category was denied stating my education does not equate to that of US Masters.On RFE, we submitted an elaborate educational evaluation from Sheila Danzig which equated my Indian bachelors to US Bachelors & my Masters to US Masters Degree.
My company is filing again in EB2;In PERM they plan to ask for ‘Bachelors degree with 5 years experience’. Is this a correct approach? Is there a possibility that USCIS would state that the baccalaureate degree should be a ONE degree and not a combination of degrees as I have a 3 yr Bachelors not a 4 yr degree as that of US? Kindly Suggest.
