Q.

EB-2 or EB-3 / changed position within company

I'm a citizen of China working for a large insurance company on the west coast. I already had U.S. master degree when I joined the company, but my job description at hiring only required bachelor degree.

One year later, I was moved to a different position with a job description that requires master degree. My qualifications at the time of hiring (one year ago) did match the requirement of his position that requires master degree.

My question is: can my company my green card application with my current job description, in EB-2 category?

At presence, my company lawyers insist on filing in EB-3, claiming that the green card job description has to be my job description at hiring, not the job description of my current position.
