Q.

What next in this case of approved I140 NIV-EB2 self petition?

I have an approved I 140 (July 2009) under NIV EB2 for which I self petitioned(priority date Aug 17th 2007)and requested adjustment of status at the time of application. At this point of time I can’t file I 485 (AOS/consular processing)as the Visa dates are not current for India. Presently I am on H1-B, but may have to leave the job for personal reasons and stay in Canada as Canadian PR.
1)Based on approved I140 can I apply for EAD and travel documents now without I 485?
2)If when the dates get current I am unemployed and outside United states (in Canada/India)can I apply for an immigrant visa and request Consular Processing? if so should I completed the form I 824 before I leave the country (USA) or any time later before the dates get current. Or does my I 140 stand invalid?
