Q.

Can H1B spouse quit working without using received EAD?

Husband/wife status H1B.Husband's(primary) I-140 approved.EAD cards received.AP approved for both.Wife's(secondary) H1B(expiry 08/15/2009)extension pending.Wife needs break from work for 2 months before working again.

Can wife quit current H1B employer(consequently losing/cancelling her H1B status) now to take immediate break from working since she has received EAD?Does application for I485 for both of us itself put us both in Adjustment Of Status status (in addition to our current H1B statuses) or do we enter AOS status only if we use the EAD?
Will the AOS status afford her protection without using H1B or EAD while on break?Can this break be indefinite without losing legal status?Can she change from EAD to H1B if needed?Can husband(primary) travel using H1B/AP?Any status issues?
