Q.

H1B Layoff, I-140 approved and I-485 pending

CPA worked on H1b visa 2nd 3 year term - started Oct 2008
140 approved Dec '06
485 pending
EAD valid Oct 2010
AP valid Nov 2009
EB3 PD Dec 06

Laid off on 5/12/09

- Am I out of status at all?

- If I find a new job and start working using EAD in the same or similar occupation, would you recommend to file AC21? Previous employer has indicated to not withdraw the I-140.

- If I find a new job and start working using EAD, can the new employer sponsor a new H1b? Would I have to leave the country for one year to get back in H1 status?

- Will there be a problem in renewing EAD and AP in the future due to the layoff?

- What are my options if I work only on EAD and say if 485 gets denied. Do I have leave immediately or can I appeal without being out of status?
