Q.

EB1 extraordinary Ability

I am applying for EB1EA (I-140, I-485, EAD and AP filing everything together). I am also applying for NIW (I-140). My H1B expires in october 2009. There is backlog of 5 months for EB1 I-140 processing. Can I stay in US if my EB1EA I-140 is pending but I have EAD through I-485 filing in EB1 category?
