Q.

H1b expires (PERM pending)

My 6th yr. H1b will be expires June 5. My PERM was filed in Dec. 08. (i-95 expires on 6/15/09)

I will leave US on June 11 and use Paid-Time-off until PERM approved. Can I be paid in my country after h1b expired?

After L/C is approved, company will do I-140 Premium process and I can come back to extend H1b visa. In this case, what visa will be available for me when i come back for h1b extnesion?

Or can I get h1b at US consulute as company applys for petition with I-140 approval for me? Per Michael Aytes Memo on 12/05/06, 7th year extension is allowed for person who is not in US as well as not in H1b status. Is it make sense?
