Q.

I-140 denied reason was 'Empployer is not USA Enterprise or co.'

I am here in USA on 8th year H1b extension,Substitute labor priority date is March 2006 and concurrent I140 on July 2007, Filed I485, EAD and Advance parole on August 2007, EAD and Advance Parole is approved for 1 year. On May 2008 I-140 got denied but I485 is pending. On June 2008- I290B, NOTICE OF APPEAL TO THE COMMISSIONEI renewed my EAD for 2years (till Nov 2010)and Advance parole for 1 year till Nov. 2009, though I140 denied but they have approved the EAD and Advance parole for second time. My husband is in India.
1. Can my husband come over USA on Advance parole since his I-485 pending? 2. What could be the reason they have not denied the I485?,3. How would you assess chance of I140 gets approved once it was denied, 4.Have you dealt with similar case,if so please your advice.
