Q.

I-140 Approval under wrong category

Hi,
We filed I-140 in EB2 and got approval under EB3. LC requires Masters+2yrs. We sent a request to ammend it to EB2 with I-140 form, LC copy, EB3 approval copy. They send back the whole package asking to send with proper fee(I-140 filing) assigning a new SRC No. tied back to the existing 485.

Q1. If something goes wrong with this EB2 140, will the approved EB3 140 still be valid ?
Q2. If I send with filing fee will it be considered as a new application? or just an ammendment ?

We even raised a service request for the same and received the notice acknowledgment.
