Q.

I140 portability and revocation

In 2005, I purchased a care home from previous owners who have filed a petition for I140 for my worker which I did not know at that time. I just found out when in 2007, the lawyer for petitioner requested evidence of ability to pay wage which we provided in an effort to help. Lawyer knew that we are the new owners. I thought that was the end of it. I asked the beneficiary(caregiver) for some documents. I learned that she was petitioned as admin. assistant, not as caregiver which she performs. In 2/2009 lawyer requested more RFE's but I declined. 1099's were used instead.

What is the ruling on portability of petition when original petitioner lost their business? Her I140 was approved on 3/09. She left her job on 3/10/09.
