I am an MBBS doctor on EB2 working at a hospital. My hospital promised they would apply for green card for me in 6 months . After about 11 months of employment they filed for LABOR certificate which was approved in March. Now the hospital lawyer and HR at my hospital tell me they have not recieved my orignal labor certicate . Therefore I was only able to file for I -140 and not for i 485 as my dates are current as USCIS does not accept i 485 without
labor certificate.
I have no way to prove that the hospital HR
and the lawyer recieved my labor certificate or not . Is this a common occurrence?
DOL does say they sent the letter in march to both HR and the hospital lawyer.
