Q.

Options after I-140 denial

My wife's I-140 application was denied recently.I was using EAD since Oct 2007 before that I was on H1b since Sept 2002.EAD is valid till Sept 2010.
We are processing to file appeal for I-140 denial.
My question is
1)How long I can legally work on EAD ?
2)Can my employer file for my GC or H1b ?

If not what are my options so I can remain legal in this country.
