Hello,

I am in the 6th year of my H1B which will expire in Oct 2009. I have an approved LCA and approved I-140 from my current employer A. My priority date is Jan 2008. I belong to EB2 classification.

I plan to switch to employer B next month. Can I get a 1 year H1B extension beyond the 6th year based on the approved LCA from employer A? Better yet, can I get a 3 year H1B extension beyond the 6th year based on the approved I-140 from employer A?

Can you also point me to any relevant USCIS article or memo that addresses my query?
