I had to come back to India due to Family energency and have been stuck here for over a 8 months now, since i got H1B stamping denial after issuing 221G.Mmeanwhile my I 140 was approved in June 2011 and my consultant is telling me that he is going to withdraw my I 140 application in next one week. Can some one please advice that if i go back to US with a different company, can i still retain my old PD even though my I 140 has been withdrawn by my EX Employer and can i apply for H1B extension based on my previous I140 approval with a new employer
