Q.

I485 Rejected - Priority Date not Current

Rejection notice says, "your priority date does not appear to be current. When your PD is earlier than the correlating cut-off date listed in the current Visa bulletin, you will be eligible to submit again".
My PD – 03/31/2009, Jan cut off – 01/01/2009, Feb cut off – 01/01/2010
After seeing the new Feb numbers on Jan 6th on the Visa Bulletin, my Company sent my application on Jan 24th. Is it possible that INS rejected my application because I sent my application in Jan and not Feb? Does the #’s announced in Feb visa bulletin become available only after Feb 1st and not from announcement date and would remain same for entire Feb even if date has retrogressed in March visa bulletin? In that case can I just resubmit now that it is Feb? Is this going to cause any problems in case decision?
