Q.

Spouse 485 while L1B till 032012

Currently spouse on L1B till 3/20/12, we will be filing her derivative I485 along with my 485 by Feb 2 week. Her company will file her extension in 3/12, what will be her status while 485 is pending & for some reason L1 gets an RFE & later gets rejected. She also has her H1b application pending w/o COS, as she travelled outside of US while her H1B application is in pending status. What are our options 1) can we apply for her 485 using current L1 & how to maintain a valid status after 0320, if her applications gets denied? We will be applying for EAD, AP as well; does this mean that she will be in status even though she has either L1 extension pending or denied, h1b/h4 application pending/denied. Or she needs to return to India and return with approved AP.Options-marriage certif has issues
