Q.

Need to move from EB3 to EB2 category

Filed my labour in July 2008 and got it approved. Labour was filed with EB2 category language. That is, Bachelors degree plus 5 years experience.

I140 petition has also been approved under EB3 Category. My lawyer filed this under EB3 category because I did my bachelors degree in India ( 3 years degree) and Subsequently completed Chartered accountant from Institute of Chartered accountant of India (3 Years) Even though I had educational evaluation for Masters degree. The justification he mentioned was, to be in the safer side.

Question

I wanted to move to EB2 category. What are the options available? Can that be done thru ‘Exceptional Ability’ category as I have 3 criteria’s fulfilled out of 7?

I have 14 years of experience as of today.
