Q.

Transfer H1B or EAD - Urgent

Dear Fred,

I would like to check with you on below. I am currently on a H1B (valid till 2011)and I also have an EAD (valid till 2010). My I140 was approved and I485 is filed by my current employer more than 180 days.

At this point, if I want to change my employer, what would be the better option - transfer my H1B or use my EAD?

1. If I transfer my H1B, what will happen to my GC process - will it just continue without
any interruption? (should I find a 3rd employer for GC only)

2. If I use my EAD instead, can I use the AC21 facility?
Do I or my new employer required to file any document to USCIS aboutthe transfer - if so what are those? Do my old and new job titles should match?

This is a very crucial - kindly respond ASAP.
