Q.

PERM appeal filed in Govt Error Queue

PERM was filed in EB2 in July 2011. Attorney made a mistake in filing. Earliest Rec process started before PWD start date.One rec effort was complete within PWD. They filed my PERM exactly a day after my PWD expired. It's a straight denial from DOL. The denial reason was "Neither the earliest date listed for recruitment step nor the date the application filed fall within the PWD validity period.This indicates the employer did not begin recruitment,nor file the application during the PWD period".
Now,lawyer says it's an error from govt.We appealed in Oct in govt queue. Lawyer cite Horizon with BALCA as example. But BALCA reversed its stance on Dec 1. Application status is "In process" now.

Any chance of my PERM getting approved?Either in Govt Q or BALCA?
