I am with my current employer since 2007.Filed perm Oct2007.Audited ,backlog'd n Denied Sep2009.Appeal initiated. New labor filed Apr2010. Appeal withdrawn.(as 2 labor's cannot exist with same emp).New labor approved Jul2010.140 approved Oct2010 .Waiting for 485 to be current with PD Apr2010.
Can I use my 2007 PD even though it was denied,since am with same employer all along.?

I know this is not possible directly. But
any latest change in laws or loop holes that permit this ,would help.( like writing to BALCA for plea etc).I am willing to go all the way to retain old PD date. PLEASE HELP.
