Q.

Approved EB3 I140 - EB2 with the same employer

I have an approved I-140 in EB3 (PD=10/2008) with my Current Employer. I had masters and 25 months of experience prior to joining this employer. When initially started the GC process, they insisted on EB3 and convinced me saying it was safer to do it that way. I have been working for this employer since 03/2007 and now they are willing to apply GC in EB2 category for me.

Am I eligible based on my education and experience to do EB2 with my current employer? If yes, will I be able to port the date from EB3? What are common reasons/chances for RFE in similar cases. What do you suggest?

Really appreciate your help.
