Q.

Eb3 to Eb2 porting and Filing I-485 Concurrently

Hello,
I have an approved EB3 with PD of DEC 07 and a pending EB2 with PD of May 2011. Porting has been requested. I am from India and the Dec bulletin cutoff for India is 15 March 08. Both petitions are with the same company. EB3 is still valid and has not been withdrawn. As per the DEC bulletin EB2 would be current asuming the PD was ported from EB3. I read in some forums that I can file I-485 with the EB2 reciept notice and the EB3 approval notice explaining the law regarding the porting of priority date and that I am entitled to have EB3 PD on the EB2 petition. Note that the EB2 reciept notice PD is May 2011. Please let me know if this really works.Can you please tell me if you had such a situation and how successful you were. Should I write a letter explaining the porting law.ThX Ken
