EB2 i140 denied because PERM says foreign degree not acceptable
Hi,
My H1B extension expires on aug 2013. Last week my EB2 I140 denied because lawyer stated on PERM that foreign degree is not acceptable.Since my degree is from a foreign institution the USCIS concluded that I am not eligible for requested benefit. Now my company lawyer preparing an appeal arguing that the PERM application had an error and that my foreign degree is acceptable. Is this a realistic appeal? what makes this appeal stronger? what options do I have if i get an unfavourable decision on the appeal as my H1b expires in aug 2013? My PERM was filed by a previous law firm that my company used. can I legally go aganist the prevoius law firm? if yes, on what grounds?
