GC- EB2 approved I140 and starting a new PERM with consular proc
Hello.My H1b visa extension stamping in New delhi got rejected based on 221g-Green color(6th year with same company and on H1b).I have approved I140 in EB2 with current priority date from same employer.
Then i found a very good company who transferred my H1b successfully but my H1b visa stamping at New Delhi again got into 221g and possible revocation(rejection).
Now, I am working in india for this new company and they are ready to file my GC.
My question : Can my new company file for GC as part of future employment while i am out of US with new Labor,new I140 with porting of my old priority date and using Consular processing instead of I1485 successfully?Any risks or rejections upfront?
