i140 Extraordinary Abiltiy in Business - Denial appeal
I have received a denial notice to my self proposed petition for extraordinary ability in business. USCIS agreed I met the minimum three criteria but did not meet the Part 2 final merits test. My petition notice was filed before the Kazarian guidelines were issued. What are my appeal options? I believe I can make the case for a MTR but ultimately would prefer my case is referred to the BIA rather than the AAO. Do I have to appeal to the AAO first at the same time as lodging the MTR?
