Promotion during Green Card
I have my I140 approved under EB-3, my PD is March 4th, 2010 and I am waiting to file my I485. I am currently on H1-B extension. I was recently denied a job promotion from my HR and company’s attorney and was advised that I should not take any promotion until I get my GC. They said that I will have to re-file/update my application, which will risk my process. However, in my PERM and I140, the proposed job title is ‘Research Associate’ while I’m actually a ‘Research Associate or RA II’ internally and is considered for ‘RA III’. The job duties remain the same and do not deviate from the description in my PERM since it was written to cover my duties for the next few years. Is it true that I cannot have promotion throughout my GC process? What are my options if I insist on the promotion.
